Social Justice Focused Law Practice

SAATH focuses on dispute resolution through litigation, negotiation, mediation, and working with authorities to resolve whistleblower claims. SAATH was established with the idea of focusing on three broad areas of law that intersect around corporate accountability, civil rights concerns, civil liberties, and public interest needs. While SAATH’s practice is not limited to these types of cases, its aim is to focus on Whistleblower Claims, Criminal Law, Sexual Assault Survivors and Civil Rights cases.

Through the collaboration with Sanford Heisler Sharp McKnight as Of Counsel, SAATH is working on international whistleblower (or qui tam) claims from India, including under legal programs that provide rewards to whistleblowers as incentives to expose illegitimate practices especially of corporations.

While corporate accountability and wrongdoing has different motivations for being pursued by authorities in different countries, by working in the U.S. and in India, SAATH works to hold corporations, banks and government operations for public harm and fraud caused by their wrongful activities. SAATH works to expose the fraud and skirting of regulations of companies that have any international activities that could be of interest to American regulators particularly focusing under the following laws:

International wrongdoing that has a connection to India or in the know of an Indian resident can be subject to a whistleblower complaint as long as the errant company:

is traded on the U.S. stock exchange – includes an American company with operations in India, a foreign company listed on the U.S. stock exchange, or an Indian company listed on the U.S. stock exchanges; or

is traded through over the counter (OTC) securities in the U.S.; or

has government contracts

Exports goods to the U.S.

does business in the U.S. (even if not listed on a U.S. stock exchange); or

is directly or indirectly doing business with a sanctioned country or a sanctioned entity and/or laundering money for a sanctioned country or sanctioned entity it can come within the fold of the law and does not even have to be a U.S. Company

SAATH is open to conversations and dialog with other lawyers in India with questions about this interlinking domestic U.S. law with international ramifications.

SAATH’s principal, Surabhi Dhar’s work in India has primarily comprised of criminal defense and constitutional protection of rights and civil liberties. With the understanding that many constitutional liberties are tested and guaranteed only through criminal law and trial courts, Surabhi’s first understanding of being a human rights lawyer was as a criminal defense lawyer.

Surabhi has also represented complainants in cases of sexual offences or in cases where the police have refused to take action, or the State is not able to conduct the prosecution. Surabhi has worked on speech and association offences, trials in body offences especially sexual assault offences, criminal writ proceedings as a petitioner, and other economic offences.

Surabhi has also worked on white collar criminal defense which also brings additional perspective to her current work on international whistleblower claims. SAATH’s criminal law is focused on trials courts in and around Delhi, the Delhi High Court and the Supreme Court although SAATH can advise and collaborate on criminal cases in other states in India. SAATH also advises and collaborates on criminal cases across other states in India.

SAATH works on anti-discrimination and anti-harassment laws of both India and the U.S.

SAATH works with victims of sexual harassment and assault in India and the U.S. to represent and advise them on the best legal action in both civil and criminal that they may want to act on.

SAATH through its collaboration with Sanford Heisler Sharp McKnight works on employment discrimination and retaliation as well as violation of civil rights in university spaces across the U.S.

SAATH also focuses on strategies with respect to retaliatory legal claims and intimidating legal tactics in India. This includes through defending SLAPP claims like defamation when made in the backdrop of speaking up about sexual harassmentor other kinds of discrimination.

SAATH works with clients in the U.S. at a pre-suit stage who may be facing employment discrimination or sexual harassment at the workplace.
